			<content:encoded><![CDATA[<p>The U.S. Coast Guard was recently assisted in the rescue of two sailors by a California Maritime Academy ship. The rescue took place off the coast of Monterey. According to the Coast Guard, they received a distress call around 1pm from a 17 foot long boat, known as the Blue Chip, carrying two passengers.</p>
<p>The Coast Guard requested the assistance of any nearby vessels as set out in search of the Blue Chip. The Golden Bear, a Maritime Academy training ship, responded to the call and agreed to assist in the rescue. The training ship had just returned from a two month international training course.</p>
<p>The two passengers were rescued, unharmed and in good condition.</p>

			<content:encoded><![CDATA[<p>Exceptionally large waves from a storm in the Pacific Ocean caused P&amp;O Cruises&#8217; Pacific Sun to go into a vicious roll that injured dozens of passengers.The New Zealand Herald has reported that at least 42 passengers have received treatment for injuries due to the rolling motion of the ship. The ship was heading to Auckland, New Zealand following an 8-day cruise through the South Pacific.</p>
<p>The 1,486-passenger ship was hit by swells of up to 23-feet and 50-knot winds. The ship&#8217;s arrival in Auckland has been delayed by 24 hours due to the storm.</p>
<p>A passenger on the ship who was in the casino at the time of one particularly large roll said that the roll of the ship caused machines to come loose from the floor and slam into passengers. The same cruise-goer said she watched plates go flying across the dining room after another large roll.</p>
<p>Individuals who are fans of Carnival Cruise Lines will recognize the Pacific Sun as the former Carnival Jubilee. The ship was built in 1986 as a sister ship to the Carnival Holiday. She was sold to P&amp;O Cruises in 2004.<br />

			<content:encoded><![CDATA[<p>The grounding of the cruise ship Empress of the North off of the coast of Alaska was the fault of the ship&#8217;s master.</p>
<p>The ship hit the ground after missing a turn at Rock Island. The probable cause of the accident was that the ship&#8217;s master assigned an inexperienced, recently licensed junior third mate to the bridge watch from midnight to 4 a.m. While the junior third mate was licensed, he was unfamiliar with the ship, the ship&#8217;s instruments, and the waters in which the ship was located.</p>
<p>In May of 2007, the Empress of the North grounded on a charted rock at the intersection of Lynn Canal and Icy Strait, roughly 20 miles southwest of Juneau. The ship hit Rocky Island even though it was illuminated by a flashing green navigation light. The crew and passengers were all evacuated safely. The ship experienced damage on the starboard side of its bottom as well as to the propulsion system.</p>

			<content:encoded><![CDATA[<p>An individual sailing a 40&#8242; sloop from Bermuda to Rhode Island who was injured while en route has been rescued by a cruise ship. The accident occurred just a few days into the 4-6 day sail north. While the boat was battling through some heavy seas, the injured sailor was knocked over by the main sheet (the rope that controls the main sail on a sail boat) and hit his head on a winch. </p>
<p>The injured individual apparently suffered a concussion as well as having a 2 and a half inch gash above his right eye. The crew of the boat took him below deck to attempt to solve the problem. Unfortunately, they were unable to stop the bleeding completely and so were forced to call the Coast Guard via satellite phone to get in touch with a doctor.</p>
<p>The Coast Guard said it would take 6 hours for one of their ships to get to the sailboat which concerned the doctor. Fortunately, there was a cruise ship nearby that was participating in the Amver program which meant it could be called upon for assistance.</p>
<p>The injured sailor was rescued by the cruise ship and patched up on board. <p>The ruling was made by a New Jersey appellate court. It overturned a previous lower court&#8217;s ruling that said they couldn&#8217;t sue due to jurisdictional issues. The lawyer for the workers says that the lower court should have considered that New Jersey was the one place the workers could have sued before tossing the case. The workers can&#8217;t sue in Spain because the U.S. Navy ships were sovereign territory.</p>
<p>The workers originally filed their case in 2004. </p>

			<content:encoded><![CDATA[<p>The pilot of the container ship that hit one of the supports for San Fransisco&#8217;s Bay Bridge has requested that some of the federal charges against him be dismissed.</p>
<p>In November, the <a href="http://maritimelawsuitattorney.com/maritime_lawsuit_what_to_remember.aspx" title="Cosco Busan" onclick="javascript:urchinTracker('/outbound/article/maritimelawsuitattorney.com');">Cosco Busan</a> struck the Bay Bridge which ripped a 90 foot hole in the side of the ship. While tearing the hull of the ship, some oil fuel tanks were torn open. This released 58,000 gallons of fuel into San Fransisco Bay. Since then, 800 migratory birds have died.</p>
<p>The pilot is asking to have some of his charges dropped due to a lack of criminal intent. </p>
<p>In other news, the government filed additional charges alleging that the shipping company is responsible for damages done to federal land and waters. The shipping company is, at the same time, asking for $60 million from the US government to cover some of the repair fees for the ship. They feel the US government owes them money as they gave a license to a pilot who had a history of alcohol abuse as well as sleeping problems.</p>

			<content:encoded><![CDATA[<p>A 49-year old stevedore of the Dumaguete port in the Phillipines died after fighting for his life for hours in Intensive Care at a nearby hospital.</p>
<p>The stevedore was apparently injured when a co-worker ran him over with a fork lift.  The victim&#8217;s supervisor says he told the victim to release the cargo net from the forklift to load cargo onto the ship. Unfortunately, the fork lift operator did not see the victim.</p>
<p>The Phillipines Port Authority  has yet to issue a statement concerning the matter. The victim&#8217;s employer has extended financial assistance to the victim&#8217;s family. He is survived by only his daughter.</p>

			<content:encoded><![CDATA[<p>Norwegian Cruise Lines has been ordered to pay the victims of a 2003 cruise ship accident more than $13 million.</p>
<p>The accident occurred in 2003 when a boiler on one of the cruise ships exploded. The accident ended up killing 8 workers and injuring 10 others.</p>
<p>In addition to the $13 million in restitution, the federal judge also ordered the company to pay a $1 million fine. A follow-up hearing will be held on June first to determine additional restitution issues.</p>
<p>The accident occurred in May of 2003 while the SS Norway was at the Port of Miami-Dade. While there, one of the 4 boilers on the ship exploded which sent super-heated steam and oil through parts of the ship. The workers that died all suffered from severe burns, according to the coroner&#8217;s office.</p>
